These Terms and Conditions (“Terms”) govern the relationship between The Spatialist Design Company (“Company,” “we,” “our”) and the Client (“you,” “your”). By engaging our services, you agree to these Terms. This agreement is governed by the laws of British Columbia, Canada.

Part 1: Use of website

1. Acceptance of Terms Welcome to The Spatialist Design Company. By accessing and using our website, you agree to comply with and be bound by these Terms and Conditions. If you do not agree with any part of these terms, please refrain from using our website.

2. Use of Website

  • You may not use this website for any unlawful purpose or in a way that violates these Terms and Conditions.

  • Unauthorized use of this website may give rise to a claim for damages and/or constitute a criminal offense.

Part I: Interior Design Services

1. Scope of Services

The Company provides residential interior design services, including but not limited to:

  • Space planning and styling.

  • E-Design services (mood boards, 3D renderings, and sourcing).

  • Home staging.

  • Furniture and decor sourcing and procurement.

  • Color consultation and soft furnishings.

2. Client Responsibilities

  • Provide accurate information regarding your project requirements, budget, and timeline.

  • Grant access to the property as required for consultations, installations, and staging.

  • Approve designs and proposals in a timely manner.

3. Fees and Payment

  • A non-refundable deposit of 50% of the total project cost is required to secure your booking.

  • The remaining balance is due before the final reveal or project handover.

  • Additional services or revisions beyond the agreed scope will incur extra charges.

4. Revisions

  • Two rounds of revisions are included with the design proposal.

  • Additional revisions will be billed at an hourly rate of CAD 80/hr.

5. Procurement and Delivery

  • The Company can assist with the purchase of furniture and decor items on your behalf. A sourcing fee of 10-20% applies.

  • The Company is not responsible for delays or damages caused by third-party suppliers.

6. Liability

  • The Company is not liable for any structural issues or damages to the property during or after the design process.

  • The Client is responsible for hiring licensed contractors for structural or electrical work.

7. Cancellation Policy

  • Cancellations made within 7 days of the project start date will forfeit the deposit.

  • Refunds for canceled services will be subject to deductions for work completed.

Part II: Event Decor Services

1. Scope of Services

The Company provides intimate event decor services, including but not limited to:

  • Backdrop styling.

  • Room decoration (balloons, flowers, light features).

  • Table settings and centerpieces.

  • Floral arrangements and ambient lighting.

2. Client Responsibilities

  • Provide accurate details about the event theme, venue, and timeline.

  • Ensure the venue is accessible for setup and take-down at agreed times.

  • Communicate any changes to the event details promptly.

3. Fees and Payment

  • A non-refundable deposit of 50% of the total service fee is required to secure your booking.

  • The remaining balance is due 7 days before the event date.

  • Additional requests or changes outside the original scope will incur extra charges.

4. Event Changes and Cancellations

  • Changes to the event date or venue must be communicated at least 14 days in advance. Rescheduling is subject to availability.

  • Cancellations made within 14 days of the event date will forfeit the deposit.

5. Setup and Take-Down

  • The Company will provide setup and take-down services within the agreed time frame.

  • The Client is responsible for ensuring the venue adheres to safety regulations and provides necessary facilities (e.g., power outlets).

6. Liability

  • The Company is not liable for damages caused by unforeseen circumstances, such as extreme weather or venue restrictions.

  • A refundable damage deposit will be required as part of the agreement to use our service, it will be calculated in the final invoice

  • The Client assumes responsibility for items rented or provided by the Company during the event and would be charged for damages

General Terms (Applicable to All Services)

1. Intellectual Property

  • All designs, proposals, and renderings remain the property of The Spatialist Design Company. Reproduction or distribution without written consent is prohibited.

2. Confidentiality

  • Both parties agree to keep all project details and communications confidential.

3. Governing Law

  • These Terms are governed by the laws of British Columbia, Canada. Any disputes shall be resolved in the courts of British Columbia.

4. Entire Agreement

  • These Terms constitute the entire agreement between the Company and the Client, superseding all prior communications and agreements.
